An expungement does not erase the conviction for all purposes. For instance, it still must be disclosed in response to questions contained in an application for public office of license by any state of local agency.

Expungement does not eliminate all possible adverse consequences or release a person from all penalties and disabilities resulting from the charges in the case:

  • Unfortunately, INS (Immigration and Naturalization Service) does not recognize expungement, so non citizens who have been convicted of crimes may find other forms of post-conviction relief more beneficial. These include failure to be advised of immigration consequences and writs of habeas corpus.
  • Information relating to the case may be available to others where the release of such information is authorized by law.
  • A dismissal under the law does not release a person of the obligation to disclose the conviction in response to direct questions continued in any questionnaire or application for public office or for licensure by a state agency.
  • A dismissal will not keep the conviction from being used against you as a prior conviction in any future criminal proceeding such as for enhancing the penalties of a criminal conviction.
  • A dismissal will not permit the convicted person to own or possess a firearm or from being convicted of a crime involving personal prohibited from possession of a firearm.
